Lakeland Distracted Driving Accidents
Texting while driving has become one of the leading dangers on streets in Florida and across the country. Texting or emailing while driving takes a driver’s attention off the road, appreciably increasing the risk of a serious car crash. Florida, in fact, has banned texting and driving entirely as a result. This move has not, unfortunately, stopped the significant rise in the number of distracted driving accidents and fatalities over the past decade. Distracted driving can be visual–taking your eyes off the road–as well as manual–taking your hands off the wheel–and even cognitive–thinking about things other than driving. Although texting while driving is the most commonly considered form of distracted driving, any of these distractions can be fatal.

Distracted Driving on the Rise
Distracted driving has been increasing in every state across the country over the past decade. Texting or emailing while driving has become one of the leading causes of car crashes, giving drunk driving a run for its money as the biggest factor leading to traffic deaths in Florida and across the U.S. Traffic safety experts have compiled some alarming statistics about texting while driving, including the following:
- Over 3,000 people are killed each year in distracted driving car accidents
- One out of every four car crashes in the U.S. is connected to texting while driving
- Drivers are six times more likely to cause an accident when texting while driving than they are when driving while intoxicated
Florida’s Texting and Driving Law
Effective October 1, 2019, texting while driving is a “primary” driving offenses in the state of Florida. Before the law went into effect, officers could only pull over a driver who was texting if they were also committing another primary offense such as speeding or running a red light. Now, you can be pulled over just for texting.
The 2019 law states that a driver may not operate a motor vehicle while “manually typing or entering multiple letters, numbers, symbols, or other characters in a wireless communications device.” Wireless communications devices include phones, laptops, video game consoles, or anything else that is designed to connect to the internet.
Violation of a traffic safety law is strong evidence of fault in a personal injury lawsuit and may even provide grounds to claim punitive damages. Punitive, or exemplary, damages are damages intended to punish and deter particularly reckless and offensive conduct and can spell a much larger recovery than the damages necessary to “compensate” a car crash victim. Punitive damages are available in Florida car accident cases where a defendant was acting in a wanton, reckless, reprehensible, and intentional way. Flagrant violation of a safety statute is strong evidence of such reckless behavior.
